Odoly Terms of Use

These Terms of Use ("Terms") govern your use of the Odoly mobile application (bundle ID com.roberttebault.MileLog) (the "App"), provided by Robert Tebault, an individual developer based in the United States ("I," "me," or "the Developer"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Apple's Standard EULA

The App is licensed, not sold, to you under Apple's Licensed Application End User License Agreement ("Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms supplement the Standard EULA. If these Terms and the Standard EULA conflict, the Standard EULA controls to the extent required by Apple. You also acknowledge that:

• These Terms are between you and the Developer only, not Apple. The Developer, not Apple, is solely responsible for the App and its content.
• Your license is limited to using the App on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
• The Developer, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer-protection or privacy claims.
• If a third party claims that the App infringes its intellectual property rights, the Developer, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

2. The App

Odoly helps you log trips (manually or with GPS while tracking is active), look up addresses and businesses, calculate driving distance, assign account codes, and create mileage reports. Features and limits may change over time.

3. Subscriptions and Purchases

Odoly offers a free tier and an optional upgrade, Odoly Pro, sold through Apple's App Store:

• Monthly: $4.99 per month (auto-renewing)
• Yearly: $29.99 per year (auto-renewing), with a 7-day free trial for eligible new subscribers
• Lifetime: $59.99 one-time purchase (non-renewing)

Prices are in U.S. dollars, may vary by region, and may change. The price shown in the App Store at checkout controls.

Auto-renewal disclosures:

• Payment is charged to your Apple ID account when you confirm the purchase, or when the free trial ends.
• Subscriptions renew automatically at the same price and for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your device's Settings → [your name] → Subscriptions, or in the App Store under your account. Deleting the App does not cancel a subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Refunds are handled by Apple under its policies (see https://reportaproblem.apple.com). The Developer cannot issue App Store refunds.

4. Your Data and Responsibilities

Your trips and account codes are stored on your device and, if you use Pro sync, in your own iCloud account. You are responsible for the accuracy of your entries, for keeping backups, and for using location features safely and lawfully. Do not interact with the App while driving. 5. Not Tax, Legal, or Accounting Advice

Mileage totals, distances, IRS standard mileage rate presets, custom rates, and reimbursement or deduction amounts shown in the App are estimates for your convenience only. GPS and mapping data can be inaccurate, and IRS rates change. The App does not provide tax, legal, accounting, or financial advice. You are responsible for verifying all figures, for checking current IRS rates and your employer's policies, and for keeping records that meet applicable requirements. Consult a qualified professional.

6. Acceptable Use

You agree not to reverse engineer, resell, or misuse the App, use it unlawfully, or use it to track another person without their consent.

7. Third-Party Services

The App uses Apple services, including MapKit, iCloud/CloudKit, and the App Store. Your use of those services is subject to Apple's terms and privacy policy. The Developer is not responsible for third-party services.

8. Intellectual Property

The App, including its design, code, and branding, is owned by the Developer and protected by law. Except for the license described above, no rights are granted to you.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DATA WILL NOT BE LOST, OR THAT TRIP OR DISTANCE DATA WILL BE ACCURATE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REIMBURSEMENTS, OR TAX BENEFITS, OR FOR ANY PENALTIES, ARISING FROM YOUR USE OF THE APP. THE DEVELOPER'S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR US $50. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

11. Indemnity

You agree to indemnify and hold the Developer harmless from claims arising from your misuse of the App or your violation of these Terms or the law.

12. Termination

You may stop using the App at any time by deleting it. The Developer may suspend or discontinue the App or any feature. Sections 5 and 9 through 14 survive termination.

13. Governing Law

These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Tennessee, unless applicable law requires otherwise.

14. Changes

I may update these Terms. The updated version will be posted with a new effective date. Your continued use of the App after an update means you accept the updated Terms.
